By accessing this Website and scheduling design services or requesting quotations, you represent that you are at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872. These Terms & Conditions constitute a legally binding agreement between you ("the Client") and Gruha Nirmaan governing your access to and use of our turnkey planning platform and spatial design services.
If you do not agree to all of these Terms & Conditions, then you are expressly prohibited from using our Website, submitting quote requests, or commissioning design works, and you must discontinue use immediately. We reserve the right, in our sole discretion, to make changes or modifications to these Terms & Conditions at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date, and you waive any right to receive specific notice of each such change.
2. Design Consultations
Gruha Nirmaan provides initial spatial layout reviews and turnkey cost estimations through our consultation forms. These initial estimations are based on client-provided layout sizes and room specifications and are intended for general budgeting purposes only. A binding execution cost is only finalized after our lead designer completes a physical site audit, takes laser-accurate measurements, and drafts the comprehensive material selection schedules.
Scheduling a consultation through our website does not guarantee slot availability, and our team reserves the right to postpone or re-schedule consultation meets based on site survey backlogs or designer availability. Design sketches, mood boards, and provisional spatial layouts generated during the initial consultation remain the exclusive property of Gruha Nirmaan and cannot be distributed to third-party carpentry contractors or fabrication channels without our written sign-off.
3. Turnkey Execution & Vendors
As part of our turnkey execution model, Gruha Nirmaan coordinates with multiple third-party suppliers, modular cabinet factories, paint crews, electrical contractors, and assembly vendors. While we supervise the execution phases to ensure adherence to spatial drawings and quality standards, the individual vendor crews remain responsible for their specific labor regulations and safety compliance on the project site.
Any modifications to finalized layout drawings requested by the Client during the active execution phase will be treated as custom change requests. Such change requests must be formally documented, signed off, and are subject to separate pricing and timeline revisions. Gruha Nirmaan will not be held responsible for project delays caused by delay in client approvals for change orders or delays in final material selections.
4. Payments & Refunds
Booking fees and subsequent milestone payments are scheduled based on the contract structure (typically 10% on booking, 40% on design finalization, and 50% prior to modular factory production dispatch). All payments must be made directly to Gruha Nirmaan's corporate bank accounts. We do not authorize cash collections by field execution staff or designer personnel. Any payments made outside our official billing channels are not recognized under this agreement.
The booking fee is partially refundable only if the client cancels the contract within 48 hours of initial signing, subject to a deduction of administrative and initial site audit costs. Once custom modular board production or raw material procurement begins at our factories, no refunds will be processed under any circumstances, and the Client remains liable for outstanding execution milestones completed by our teams.
5. Material Procurements
Gruha Nirmaan prides itself on transparency regarding raw material brands. We utilize premium plywood (BWP grade), laminate sheets, and hardware brands (such as Hettich or Hafele) as specified in our contract schedules. In the event of market unavailability of a particular brand or model of material, we will propose equivalent alternatives of equal or higher value. Execution will proceed only after receiving the Client's written consent for the alternative brand.
Client-sourced materials, fixtures, or appliances (such as customized lights, specialized vanity basins, or built-in ovens) must be delivered to the project site on or before the dates specified by our execution manager. Gruha Nirmaan is not responsible for damages, installation misfits, or warranty claims arising from client-sourced materials or fixtures installed by external local crews.
6. Site Access & Permissions
The Client is responsible for securing all necessary site access permissions from housing society offices, municipal authorities, or building management associations before the scheduled project commencement date. This includes procuring work permission letters, society NOCs, defining society execution hours (e.g. 9 AM to 6 PM, no noisy work on Sundays), and arranging elevator access for modular cabinet delivery.
Delays in work caused by local residents' complaints, housing society restrictions, electricity shut-offs, water supply unavailability, or municipal stop-work notices will automatically extend the project timeline. The Client agrees to provide clean, stable electricity and water supply at the site throughout the execution phase at their own cost.
7. Limitation of Warranties
Modular products fabricated by Gruha Nirmaan (such as modular kitchen cabinets, wardrobes, and study units) carry a limited warranty against manufacturing defects for the duration specified in the client contract. This warranty covers wood rot, de-lamination under normal usage, and hardware functionality. It does not cover water leakage damage from client-plumbing issues, dampness in building walls, or regular wear and tear.
Loose furniture pieces, soft furnishings, and decorative items (like wallpaper, paint finishes, and lighting fixtures) are subject only to the respective manufacturer's warranties. Gruha Nirmaan does not offer direct warranties on third-party products. We will assist the Client in raising warranty claims with the manufacturers, but we hold no liability for their decisions.
8. Intellectual Property Rights
All design assets, including 3D renders, CAD drawings, elevation drawings, color palette charts, and custom furniture sketches created by Gruha Nirmaan designers, are our intellectual property and are protected by Indian copyright laws. These assets are provided to the Client under a non-exclusive license solely for execution at the specified project address and cannot be reused for other properties or commercial replication.
Gruha Nirmaan reserves the right to photograph, take video walkthroughs, and document the completed interior design project for marketing, portfolio presentation, social media distribution, and design journal publications. We respect client privacy and will ensure that no personal identifiers (such as nameplates, family photos, or specific block/flat numbers) are visible in our marketing media.
9. Legal Jurisdiction & Dispute Resolutions
Any dispute, controversy, or claim arising out of or relating to these Terms & Conditions, including the validity, invalidity, breach, or termination thereof, shall be settled by mutual arbitration. The arbitration shall be conducted by a sole arbitrator appointed mutually by both parties, and the venue of arbitration shall be Mumbai. The proceedings shall be conducted in English in accordance with the Arbitration and Conciliation Act, 1996.
In the event that arbitration does not resolve the dispute, any legal proceedings or court actions arising out of this agreement shall be subjected to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra. These terms shall be governed by and interpreted in accordance with the laws of India.
